Terms of Service

Last updated: [EFFECTIVE DATE]

Draft. These terms are not in effect yet and still need a review before launch. Items in brackets are filled in at launch.

1. Who we are

Jump Gate Networks ("we", "us") is a hosting service operated by [LEGAL NAME], [CITY, STATE]. These terms cover our hosting, the customer dashboard at portal.jumpgatenetworks.com, and this website. By using any of them, you agree to these terms.

2. Your account

  • Keep your login details private. You are responsible for what happens under your account.
  • Give us accurate contact details and keep them current. We use them for alerts, invoices and notices.
  • If you are under 18, a parent, guardian or your school must agree to these terms and hold the account for you.

3. What we provide

We host the websites, web apps and databases described in your written quote. That includes deploys from your GitHub repository, HTTPS, uptime monitoring, a status page, backups as described in section 7, and support by email or dashboard ticket.

We may improve or change features. If a change takes away something you rely on, we tell you at least 30 days ahead.

4. Your content and code

  • You keep ownership of your code, content and data.
  • You allow us to store, copy, run and back them up only as needed to provide the service.
  • You are responsible for having the rights to what you host, for your site following the law, and for how your site handles its own users' data.
  • Everything you host must follow our Acceptable Use Policy.

5. Fees and payment

  • Fees are set in your written quote and billed [MONTHLY / YEARLY] in advance.
  • If a payment is late, we email you. If it is still unpaid 14 days after that email, we may suspend the service until it is paid.
  • We don't refund partial billing periods, except when we end the service without cause. Then we refund the unused part.
  • We give at least 30 days' notice before changing your price.

6. Uptime and support

We work to keep your site running and we publish our real uptime and every incident at status.jumpgatenetworks.com. We don't promise a specific uptime percentage unless your quote states one. We announce planned maintenance at least 48 hours ahead where we can.

7. Backups

Databases are backed up every 15 minutes and files nightly. Backups are encrypted, stored off-site, kept for 30 days, and restores are tested. Backups lower the risk of losing data but cannot remove it, so keep your own copy of anything you can't afford to lose. Your code always stays in your own GitHub repository.

8. Security

The safeguards we use are listed in our Data Processing Addendum. Tell us right away if you think your account or site has been compromised. If an incident affects your data, we tell you without undue delay.

9. Cancelling and suspension

  • You can cancel any time with [30] days' notice by email or dashboard ticket.
  • We may suspend a site right away if it breaks the Acceptable Use Policy, puts other customers or our systems at risk, or if payment is overdue as described in section 5. We tell you why unless the law prevents it.
  • After the service ends, you have 30 days to export your data. Then we delete it. Copies in backups expire within the following 30 days.

10. Disclaimers and limits

To the extent the law allows, the service is provided "as is". We are not liable for indirect or consequential losses, such as lost profits or lost data you could have restored from your own copy. Our total liability for any claim is limited to the fees you paid us in the 3 months before the claim.

11. Changes to these terms

If we change these terms in a way that matters, we email you at least 30 days before the change takes effect. If you don't agree, you can cancel before then without penalty.

12. Governing law

These terms are governed by the laws of [STATE], United States.
